Pursuant to § 713 of the Florida Statutes, a Notice to Owner must be served on the Owner of real property by any potential lienor/claimant who is not in privity of contract with the Owner (i.e. sub-contractors, sub-contractors, material supplies). If your contact is with anyone other than the owner, you must serve a Notice to Owner in order to secure your lien right. If you have any doubt about serving a Notice to Owner, go ahead and serve it because it can't hurt. In most cases, the Notice must be served on the Owner or his designated agents within 45 days of the first day of work, delivery of materials or beginning fabrication of specially fabricated materials whichever one is the earliest date.
